Scooter Libby to be Indicted; Rove May Miss Bullet for Now

In my report the other morning after my accident, I mentioned that a prominent journalist had shared this:

My sense is that the Rove team is feeling more confident today, the Libby team despondent

This squares with the New York Times report this morning that Libby is up for indictment this morning -- and Rove has missed the bullet for the time being:

Lawyers in the C.I.A. leak case said Thursday that they expected I. Lewis Libby Jr., Vice President Dick Cheney's chief of staff, to be indicted on Friday, charged with making false statements to the grand jury.

Karl Rove, President Bush's senior adviser and deputy chief of staff, will not be charged on Friday, but will remain under investigation, people briefed officially about the case said. As a result, they said, the special counsel in the case, Patrick J. Fitzgerald, was likely to extend the term of the federal grand jury beyond its scheduled expiration on Friday.

Karl Rove, President Bush's senior adviser, was the subject of intense speculation Thursday as he arrived at the White House.

As rumors coursed through the capital, Mr. Fitzgerald gave no public signal of how he intended to proceed, further intensifying the anxiety that has gripped the White House and left partisans on both sides of the political aisle holding their breath.

So, today -- shortly -- we should see whether this is on track. We should also get an indication of whether Fitzgerald will seek extension of the investigation to pursue new questions that have emerged -- particularly if he has chosen to pursue questions regarding the source of "Niger/Uranium documents" and the promulgation of those by sources in the administration as part of a scheme inside the administration to hype the WMD threat.

"The White House -- and lawyers for White House advisers Karl Rove and I. Lewis "Scooter" Libby -- braced for the possibility of indictments, although there were signs that Fitzgerald was keeping them guessing to the bitter end.

People close to the investigation said that, as of late Thursday afternoon, Rove had received no notice that he was going to be indicted. Some observers took that as a sign that the longtime Bush strategist might emerge from the investigation without being charged.

But others said that Fitzgerald might be waiting until Friday to alert those being charged to reduce the chances of last-minute leaks about his intentions.

Robert Luskin, Rove's lawyer, declined to comment. Libby's lawyer, Joseph Tate, didn't respond to multiple messages."

TalkLeft is saying this means Rove likely cut a deal with Fitzgerald and, if he does as told over the next months (while being "further investigated"), may get out of going to jail.

Re the new office space for Fitzgerald, Richard Sale says this: "He has obtained new office space across the street from his present New York Avenue office..." http://turcopolier.typepad.com/sic_semper_tyrannis/2005/10/state_told_libb.html

Is this just your "goof" coming full circle, or is this another, different, office space?

Is it true? Were you told to back off? I don't believe Richard Sale used you as a source of his information. There would have been attribution. Most of his sources seem to be Agency operatives commenting on deep background, as would be expected from Sale by virtue of his history with the Agency.

Rove withheld information under oath. There is no way Fitzgerald will let him skate. Rove has either made a deal or has somehow delayed the inevitable.

Ohhhh please let there be an extension and/or a new GJ enpaneled... please! That would mean, I think, that Fitz is going after bigger fish.

Yes, that's my hunch too. I'm happy to let dirty-tricks Rove off, though much damaged, as he's not part of the neocon hardcore. Think of the whole lot of them, Leeden, Perle, Cheney, Rumsfeld, etc. getting nailed once and for all for lying Congress into war.

Perhaps Rove DID flip. But then BushCo would be crazy to keep him inside the loop. Why are they? I mean he is still in the WH.
